Terms & Conditions
1. Introduction
These Terms & Conditions govern the provision of services by O’Regan’s Excavation (“we”, “our”, “us”) to the customer (“you”, “your”).
By accepting a quotation, booking services or instructing us to commence work, you agree to these Terms & Conditions.
2. Quotations
All quotations are provided free of charge and are valid for 30 days unless otherwise stated.
Quotations are based on the information available at the time and may be subject to revision should site conditions, access requirements or project specifications change.
3. Booking & Acceptance
Work will only be scheduled once a quotation has been accepted.
We reserve the right to decline any project at our discretion.
4. Payment Terms
Payment terms will be confirmed within the quotation or invoice.
Unless otherwise agreed:
- Domestic customers must pay upon completion of work.
- Commercial customers must pay within 14 days of invoice date.
- Late payments may be subject to interest and recovery costs permitted under UK law.
We reserve the right to request deposits for larger projects.
5. Access & Site Conditions
The customer is responsible for ensuring suitable access to the site.
Any hidden obstacles, underground services, drainage systems, foundations, utilities, tree roots, rock or ground conditions that are not visible before work commences may result in additional charges.
Additional work required due to unforeseen site conditions will be discussed and agreed before proceeding where possible.
6. Underground Services
Whilst every reasonable effort will be made to avoid damage, the customer remains responsible for identifying and disclosing the location of any underground services including:
- Water pipes
- Gas pipes
- Electrical cables
- Drainage systems
- Telecommunications services
We shall not be liable for damage to services that have not been disclosed or accurately identified prior to commencement of works.
7. Excavation & Groundworks
Ground conditions may vary significantly from those anticipated.
We reserve the right to adjust methods, equipment requirements or pricing where ground conditions differ from those reasonably expected.
8. Waste Removal
Unless specifically included within the quotation, waste removal, spoil removal and disposal costs are excluded.
Where waste disposal is included, materials will be disposed of in accordance with applicable regulations.
9. Weather Delays
Work may be postponed, suspended or rescheduled due to adverse weather conditions, unsafe site conditions or circumstances beyond our control.
We shall not be liable for delays caused by such events.
10. Landscaping & Garden Works
Natural products and living materials may vary in colour, appearance and growth.
We cannot guarantee the future performance, survival or growth of plants, turf or other living materials once installed.
11. Handyman & Property Maintenance Services
We will carry out all work with reasonable skill and care.
We cannot be held responsible for pre-existing defects, hidden damage or deterioration that becomes apparent during the course of the works.
12. Limitation of Liability
Our liability shall be limited to the value of the services provided.
We shall not be liable for:
- Indirect or consequential losses
- Loss of income or profits
- Delays outside our reasonable control
- Damage arising from undisclosed site conditions
Nothing in these Terms excludes liability where it cannot legally be excluded under UK law.
13. Cancellations
Cancellations should be made as soon as possible.
We reserve the right to recover costs already incurred, including materials ordered, plant hire, waste disposal arrangements and labour costs committed to the project.
14. Complaints
Any concerns regarding completed work should be raised within 14 days of completion.
We will endeavour to investigate and resolve all genuine complaints fairly and promptly.
15. Governing Law
These Terms & Conditions shall be governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
